ACCEPTABLE USE POLICY

Effective Date: March 1, 2026

This Acceptable Use Policy (“AUP”) governs use of the RiskGATOR software platform operated by Awesome Numbers.

By accessing or using RiskGATOR, users agree to comply with this AUP.

1. Permitted Use

RiskGATOR may be used solely for:

  • Laboratory quality control configuration and analytics
  • Instrument and assay performance monitoring
  • Operational and administrative quality assurance activities

Users must use the Service in compliance with all applicable laws, regulations, and contractual obligations.

2. Prohibited Use

Users must not:

  • Upload, store, transmit, or process patient-identifiable information
  • Upload personal health information (PHI), including names, health card numbers, medical record numbers, or other identifiers
  • Attempt to bypass security controls or access unauthorized data
  • Interfere with system integrity, availability, or performance
  • Use the Service for unlawful, deceptive, or malicious activities

3. Data Responsibility

Customers are responsible for:

  • Ensuring that all data uploaded to RiskGATOR complies with this AUP
  • Training authorized users on appropriate data handling
  • Preventing the inclusion of patient identifiers in uploaded datasets

Awesome Numbers reserves the right to suspend or terminate access for violations of this AUP.

4. Enforcement

Violations of this AUP may result in:

  • Temporary suspension of access
  • Permanent termination of accounts
  • Notification to customer administrators
  • Other actions as required by law or contract

🚫 NO-PHI & HIPAA DISCLAIMER (Publishable)

No Protected Health Information (PHI) Policy

RiskGATOR is not designed to collect, store, process, or transmit Protected Health Information (PHI) as defined under the U.S. Health Insurance Portability and Accountability Act (HIPAA) or patient-identifiable health information under Canadian privacy laws.

Specifically:

  • RiskGATOR processes laboratory quality control and analytical data only
  • No patient names, identifiers, diagnoses, or medical records are required or supported
  • Customers are contractually prohibited from uploading PHI or patient-identifiable data

As RiskGATOR does not process PHI:

  • Awesome Numbers is not a HIPAA Covered Entity
  • Awesome Numbers is not a HIPAA Business Associate
  • HIPAA does not apply to the Service by design

Customers remain responsible for ensuring that no PHI is introduced into the Service in violation of this policy.
